Jeffrey Norris has been found guilty of first degree murder in the brutal 2005 death of Mindy Acosta. The evidence against him was overwhelming.

DNA taken from Acosta's body and on the condom wrapper found next to her was a match to Jeffrey Norris.

He admitted he had sex with Mindy for money.

Later he told his girlfriend he had been in a fight and the other person had died.

Finally, a series of text messages and phone calls to his mother saying "If you take a life you must give one."

That first degree murder charge came with a life sentence.

The case was prosecuted by Assistant District Attorney Carrie Munsee and Chief Deputy Robert Sambroak.


07/21/2011 UPDATE: Jeffrey Norris, the former Erie man who was found guilty in June of raping, beating and strangling 30-year-old Mindy Acosta in an Erie baseball field in 2005, will serve life plus seven to 20 years in prison.

Foster Mother Sentenced to Jail for Severely Beating Her KidsMay 9, 2011, 10:24 am

A local woman, convicted on charges that she badly physically abused her four adopted children, will spend at least 6 years behind bars.
A judge Monday morning sentenced 41 year old Annissa Schoolfield to 6 to 12 years in prison.

Back in March, an Erie county jury came back with a split verdict in the case against.

Monday morning, a judge sentenced Schoolfield to 18 to 36 months on the 4 felony counts of endangering the welfare of children.
Schoolfield repeatedly abused the children, who ranged from 7 to 12 years old, over the course of several years.

Assistant District Attorney Beth Hirz prosecuted the case for the Erie County District Attorney's Office.

March 3, 2011:

Two Plead Guilty to Murder/Robbery

18-year-old Brandon Barns plead guilty, to 3rd degree murder, this morning. His co-defendant,19-year-old Stephen Carter, plead guilty to one count of robbery. It's for the robbery and shooting death, of 30-year-old Joshua Thompson. According to police, Thompson knew both the suspects. The men were all in a car together when Barnes pulled a gun on Thompson after the two started to rob him. He was shot in the head, while sitting in a car. Thompson died, 2-days later. Both men will be sentenced on April 14th

Donald Howard Guilty of Second Degree Murder

The Erie man, on trial for murder for the second time, has been found guilty.
Late Thursday evening, the jury came down with a guilty verdict, for 47 year old Donald Howard.

He was found guilty of second degree murder, for the beating death of 79 year old Raymond Goodwill, during a robbery in 2009.

This was his second trial, Howard's first trial ended in a mistrial.
It took this jury about 2 hours of deliberation to come back with this guilty verdict.

District Attorney Jack Daneri and ADA Erin Connelly prosecuted the case.

A jury found 21 year old Tyler Keys guilty of first degree murder
.
He's now convicted with murder and arson, in the death of 51 year old Peggy Sue Gaerttner.

When Keys took the stand Wednesday, he claimed Gaerttner allowed him into her apartment, and after an argument she attacked him. During his testimony, he admitted to stabbing Gaerttner twice in the back, but he claims it was in self-defense. Assistant District Attorney Roger Bauer argued, it was not self defense, saying keys stabbed Gaerttner 20 times.

Lumsden guilty of involuntary manslaughter

Joseph "Santa" Lumsden was found guilty of involuntary manslaughter this afternoon in the February stabbing death of 35-year-old Gregory Pianka.

With the verdict, the jury rejected Lumsden's claim that he stabbed Pianka in the Hi & Dri Pub in self-defense.

Assistant District Attorney Brian Krowicki prosecuted the case.

Lemon found guilty of third-degree murder in Erie shooting

The prosecution and defense asked jurors to choose between starkly different versions of the shooting that claimed 19-year-old Steven Arrington II's life on Jan. 5 in front of a Buffalo Road market.

Larry Lemon, they argued, either shot Arrington in self-defense or committed the worst kind of killing -- murder in the first degree, an intentional killing with malice.

The Erie County Court jury rejected both claims.

After deliberating for more than seven hours over two days, jurors on Friday settled on a verdict that fell between the charge of first-degree murder leveled by the prosecution and Lemon's claim that he fired justifiably in self-defense.

The seven-man, five-woman panel convicted Lemon, 18, of third-degree murder, finding that he shot Arrington with gross recklessness and malice. The jury also found him guilty of aggravated assault, reckless endangerment, possessing the instrument of a crime and two weapons charges.

Lemon did not visibly react to the verdict.

Chief Deputy District Attorney Elizabeth Hirz said the prosecution was pleased with the outcome.

"It was a tough case, and we are very thankful to the jury for doing their job. They were very committed, very focused," she said.

Hirz said evidence that suggested Arrington had drawn a .22-caliber handgun during the confrontation with Lemon made it difficult for the prosecution to get the first-degree murder conviction she and Assistant District Attorney Carrie Munsee sought.

"It was a difficult case. But we felt very strongly about the case we did present. This was in no way self-defense," she said.

Arrington's parents, Steven and Sonya Arrington, declined to comment. Sonya Arrington founded Mothers Against Teen Violence after the shooting.

July 22, 2010:

Nicole Clair Arbaugh, 33, pleaded guilty to one count of voluntary manslaughter in a plea deal that dropped charges of aggravated assault, reckless endangering another person, and possessing the instruments of a crime.

The plea was handled by Assistant District Attorney Brian Krowicki.

Erica Dunston Receives Life Sentence

Erica Dunston, age 30, was sentenced to life in prison today after she pleaded guilty to murdering her father in an arson in 2007. Dunston pled guilty to second-degree murder and arson. District Attorney Jack Daneri handled the plea.

President Judge Ernest J. DiSantis Jr. sentenced Dunston immediately.

Erie man sentenced to 40 to 80 years in robbery spree

A robbery victim told a judge Wednesday that Austin Lee Bemis stole her dignity with each piece of clothing he made her remove during a holdup last summer.

"He is a sick and dangerous human being who should never be allowed to walk the streets again," she said to Judge Ernest J. DiSantis Jr.

DiSantis agreed that Bemis, a 20-year-old with a history of serious sex offenses, posed a danger that outweighed any hope of Bemis' quick rehabilitation. He sentenced Bemis to 40 to 80 years in state prison on five counts of robbery and one count of attempted robbery.

DiSantis credited Bemis for pleading guilty and sparing the victims from having to testify at trial. He also said Bemis, because he is young, might be rehabilitated.

But the judge said that Bemis' crimes against five Erie women last summer and Bemis' history -- which includes a juvenile conviction for raping an 8-year-old girl -- shows Bemis has "deep-seated issues which have to be addressed."

"You are a clear and present danger," DiSantis said.

The victim who testified told DiSantis that Bemis wore a mask and pushed a gun into the side of her head. She said she still hears his voice and suffers from insomnia and anxiety.

The sentence was driven in part by the mandatory minimum sentences of 10 years that was required on each of the robbery charges because Bemis committed the robberies with a gun. DiSantis ordered Bemis to serve four of the sentences consecutively. The last two, he said, will be served concurrently with the other charges.

Bemis' lawyer, Assistant Public Defender Matthew Dante, asked the judge to sentence Bemis with an eye toward rehabilitation, not punishment.

Bemis apologized for the pain and fear he caused the victims. He told the judge the crimes were "out of character" for him and that he tried to commit suicide after the first robbery.

"I am really not a bad person like the media made me out to be," he said. "I am easygoing and laid back."

Assistant District Attorney Erin Connelly countered that Bemis planned the attacks in advance and even used a Taser on one woman.

"I don't think he understands the consequences of his actions," she said.

The sentence came after Bemis pleaded guilty in March to robbing five women on Erie's lower west side and trying to rob a sixth. He admitted that he used a gun each time. The attacks happened between May and August 2009.

One of the women gave him $10. Another handed over a pack of Newport cigarettes.

Erie police said Bemis made two of the women undress. Police said he took photos of one of the women after she disrobed.

Bemis was not charged with sexual assault. Erie Police Chief Steve Franklin has said the charge did not apply because Bemis did not touch the women.

Police caught Bemis a few steps from his residence in the 200 block of West 16th Street. They were tipped off by a woman who called 911 after Bemis robbed her Aug. 8 as she walked in the 100 block of West 11th Street.

Police said Bemis was carrying a toy handgun, a digital camera, a bandanna and a latex glove when they caught him.

Franklin and Mayor Joe Sinnott were criticized before the arrest for not having warned nearby residents of the robberies, which had started in May.

Word of the attacks did not become public until July 8, when an Erie Times-News reporter asked Franklin about them. By then, five women had filed reports.

Franklin defended his decision, saying publicity about the crimes could have caused panic. He said the matter was being investigated aggressively, and that two officers on special duty for the attacks were responsible for Bemis' capture.
